Full terms and conditions ‘Win your Flavourite Day’ Promotion at Nisa/Costcutter stores

1.     This ‘Wall’s Win your Flavourite Day’ text-to-win prize draw promotion is open to UK residents aged 18 or over except employees of the Promoter, their families, agents or anyone professionally connected with the promotion.

2.     The promotion will take place in participating Nisa and Costcutter stores across the UK, starting on 4 June 2012 and ending on 24 June 2012.

3.     This promotion runs across the entire Wall’s single Magnum, Cornetto, Solero, Feast, Calippo, Twister, Mini Milk, X-Pop, Chunky Choc Ice and Haribo ice cream ranges (excludes multipacks), subject to store availability.

4.     To enter, participants are required to purchase a Wall’s single ice cream between 4 and 24 June 2012 in any participating Nisa or Costcutter store and text in ‘WALLS’ followed by the last 4 digits in their ice cream’s barcode to: 66644.

5.     No purchase necessary in Northern Ireland only.  For an equal chance to win, send your name, full address and mobile phone number on a postcard to Wall’s ‘Win your Flavourite Day’ (Nisa/Costcutter), Freepost RRLT-EEAS-XBSJ, PO Box 7557, Derby DE1 0NP, England to receive a participation code.

6.     Text entries will be charged at a standard network message rate and may not be included in any inclusive text message package.

7.     Entrants must retain their receipt as proof of purchase.

8.     No applications from agents, third parties, organised groups or applications automatically generated by computer will be accepted. No incomplete or corrupted entries will be accepted.  Entries will only be accepted if they comply with all entry instructions.

9.     The promotional text-to-win line will be open from 4 June 00:01 hrs (BST) and close indefinitely on 24 June at 23:59 hrs (BST). The daily deadline to enter the day’s prize draw is 23:59 hrs (BST) every day. Closing date for receipt of text entries is 24 June at 23:59 hrs (BST). Text entries received after the closing date will not be entered but may still be charged.

10.  For each day of the Promotion Period, all valid entries received in one 24 hour period from 00:00 hrs until 23:59 hrs, inclusive, will be placed into the daily prize draw for the day they are received, up to 23:59 hrs (BST) on 24 June 2012. 

11.  Responsibility is not accepted for entries lost, damaged or delayed as a result of any network, computer hardware or software failure of any kind. Proof of sending will not be accepted as proof of receipt.

12.  Winners will be drawn Mon-Fri, one day after the entry date. Any entries received on Saturdays, Sundays or Bank holidays will be drawn on the first working day afterwards.

13.  Only one text-entry per mobile number, per day is permitted to the daily draw. No entrant may win more than one prize. Any subsequent win will be declared void and a new winner selected by an independent judge from the remaining valid entries of that day’s draw.

14.  There will be a total of 21 daily prize draws (one per day) from 4 June 2012 until 24 June 2012, inclusive. The first valid entry drawn at random by an independent judge, from all entries received by the closing date for each daily draw, will win a lifestyle voucher in the value of up to £170. A range of vouchers will be available to select from (Pamper days, Theatre trips, Activity experiences, Family day at London Zoo and Family day at a theme park). Vouchers can be redeemed online and by phone via Unmissable Ltd and are valid for 10 months from the day the voucher is received. All prize options are subject to availability and may not all be available in all locations. Prizes exclude any expenses occurring for travel, food etc, unless specified as being part of the prize package.There is no cash alternative to the prizes, and the prizes are not transferable.

15.  In the event of any dispute the decision of the Promoter is final. In the event of unforeseen circumstances the Promoter reserves the right to substitute the prize for an alternative of equal or greater value. No correspondence will be entered into.

16.  Winners will be notified by text message within 3 working days after the draw.

17.  Winners are required to have internet access in order to claim their prize.  

18.  Winners must claim their prize by logging into an online portal (via an authentication code they will be sent) in order to leave their personal details (full name, contact address, number and email) within 14 days of receiving the winners text notification. If the prize is unclaimed after this time, it will lapse and the Promoter reserves the right to offer the unclaimed prize to a substitute winner selected at the same time as the original.

19.  Winners will receive their prize vouchers within 30 days of claiming their prize.

20.  The winners’ details (name and county) will be made available on request to those writing to Wall’s ‘Win your Flavourite Day’ (Nisa/Costcutter), PO Box 10220, Sutton Coldfield, B76 1ZH within ten weeks after the published closing date, enclosing a stamped and addressed envelope (SAE).

21.  The winners may be required to participate in publicity arising from this promotion at no expense to the promoter.

22.  By entering the promotion, all entrants will be deemed to have accepted and be bound by the rules and consent to the transfer of their personal data to the Data Controller for the purposes of the administration of this promotion and any other purposes to which the entrant has consented. All entry instructions form part of the rules.

23.  The Promoter cannot accept any liability for any failure of hardware, software, computer, phones or other systems which may result in any entry or other information about the entrants or the promotion being lost, damaged, delayed or corrupted in any way. Entries not in accordance with the entry instructions will be rejected.

24.  The Promoter reserves the right at its sole discretion to disqualify and / or withhold the prize(s) of any individual found to be tampering with the entry process or operation of the website or to have acted in any manner deemed by the Promoter to be in violation of these terms & conditions.

25.  The Promoter shall not be liable for any loss, damage or consequential damage of any nature in contract, tort (including negligence) or otherwise caused by acceptance of the terms and conditions or in connection with the prize (to the extent permissible by law).

26.  These Terms and Conditions and any issues or disputes which may arise out of or in connection with these Terms and Conditions (whether such disputes or issues are contractual or non-contractual in nature, such as claims in tort, for breach of statute or regulation or otherwise) shall be governed by and construed in accordance with English law. Entrants hereby irrevocably submit to the exclusive jurisdiction of the English courts to settle any such dispute or issues.
